Each state has its own laws with regard to surrogacy and egg donation. It is mandatory that the
surrogate/egg donor and the recipients have a contractual agreement in place before any
reproductive procedures begin. The agreement allows the parties to express their understanding
of their respective rights and responsibilities. Once the contract is complete and signed, the
parties can proceed with their IVF cycle with greater confidence.
Since there are few or no laws regulating surrogacy/egg donation, the contract is important in
the event of a disagreement. Traditionally, the courts have looked to the intent of the parties,
governed by the agreement to resolve disagreements.
